General standard terms and conditions

1. Subject matter of the contract

The General Terms and Conditions presented here govern the relationship between the Bruno Manser Fund (hereinafter referred to as "BMF") and the buyer (hereinafter referred to as the "customer") of the products supplied by BMF.

2. Order

The customer's order is placed by filling out the order form provided on the BMF website and clicking on the dialog box "Order confirmed". BMF is always entitled to refuse orders.

3. Finalisation of the contract

The contract is finalised when the order is confirmed by BMF.

4. Delivery

In principle, BMF is able to make deliveries to all destinations within Switzerland and the European Union. If for any reason it is not possible to deliver the goods to a certain country, the customer will be notified. The orders are sent by Swiss post as "B-Post". If certain articles are, exceptionally, not in stock, BMF will inform the customer of the estimated delivery date.

5. Prices

The prices published on the BMF website are quoted in Swiss francs and include shipping costs.

6. Payment terms

Payment is to be made directly to BMF by means of Postfinance, a credit card, PayPal or through advance payment to one of the BMF's accounts. Customers can decide for themselves which mode of payment they prefer.

7. Right of return

Should the customer not be satisfied with the goods provided by BMF, they shall be entitled to send the goods back to BMF without giving reasons and will be refunded the purchase price (without shipping costs). The customer must submit their declaration of return within ten days of delivery of the goods. The returned goods shall only be accepted if they are undamaged. The costs for the return are to be borne by the customer and shall not be refunded.

8. Warranty

If, within 12 months of delivery, the goods provided by BMF are seen to contain a defect which is not due to natural wear or improper handling, BMF will replace the defective product free of charge. Any additional warranty or guarantee claims by the customer are excluded.

9. Liability

BMF shall not assume any liability for damage that has not occurred to the product itself.

10. Severability clause

If any provision of the present General Terms and Conditions is held to be unenforceable, the enforceability of all remaining provisions shall not be affected thereby.

11. Applicable law and jurisdiction

The sales contract finalised between the customer and BMF, including the present General Terms and Conditions, is subject to Swiss law with the exception of the U.N. Convention on Contracts for the International Sale of Goods (CISG). Any disputes arising from or in connection with the sales contract shall be settled exclusively by the courts of Basel, Switzerland.
